Project Update

  1. Development Agreement. The City and Pizzuti continue to discuss overall terms and schedule associated with the Development Agreement. The next step in the process is to finalize the Purchase and Sale Agreement and then proceed with the details of the Development Agreement and preliminary site plan approval process.

  2. Purchase and Sale Agreement. The City and Pizzuti agreed to general language in the Purchase and Sale Agreement and it was scheduled for City Commission action in July. The City Manager requested a table to August 16, 2007 to address questions and make some final modifications to the agreement. The City is to provide final language to Pizzuti for review in time for an updated staff report and agenda item for the August 16, 2007 Commission meeting.

  3. Concurrency Management Review. Submitted Concurrency Review request to the City in April, 2007. City has advised that they have started their review.

  4. Project Input. The project architect is updated the design based on the market study, charrette input and comments from the commissioners. The final mix of uses is being developed and is primarily limited by available parking.

  5. Site Evaluations. As part of the site investigation process, additional environmental (Phase 2) and asbestos surveys are necessary. In addition, some level of remediation will be necessary before the site can be redeveloped. As part of the geo‐technical testing, additional costs associated with soil conditions will have to be addressed. Demolition of existing improvements on the site has also been estimated. Discussions with the City are occurring on these project impacts.

  6. Wellhead impacts. The wellhead located adjacent to the site is being researched to confirm impacts to the development plan. The City has indicated that they are addressing with their codes and discussions with the county and State of Florida and they do not anticipate a negative impact to the project and redevelopment of the original site or the adjacent parcel.
